1. Acceptance of Terms
Before you may measure, configure, or receive pricing for any product, you must affirmatively accept these Terms of Service by checking the acceptance box or clicking “I Agree” (or a materially identical acceptance control) presented on our site. You must affirmatively accept these Terms a second time, immediately before you submit payment, in order to complete your order. Your click or checkmark constitutes your electronic signature and your binding acceptance of these Terms in their entirety, valid and enforceable under Oklahoma law (Okla. Stat. tit. 12A, § 15-107(b)) and federal law (15 U.S.C. § 7001(a)(2)). If you do not affirmatively accept these Terms at each point where acceptance is required, you will not be permitted to measure, configure, price, or purchase any product.
If you visit our website only to browse, without measuring, configuring, or placing an order, these Terms apply to you only with respect to your use of the site itself — including our intellectual property rights, site disclaimers, and the limitation of liability set out in these Terms. The provisions governing ordering, fabrication, measurement responsibility, shipping, and warranty apply to you only once, and to the extent, you begin configuring a product or place an order.

3. Description of Service
Our website allows you to configure custom glass products to your own measurements, view live pricing based on your configuration, and place an order online. Every item we produce is fabricated from tempered glass, specifically for your order, based on the specifications you provide — nothing is stocked or pre-made to standard sizes. Orders are crated for freight and shipped nationwide within the United States. We currently ship only to addresses within the United States. Estimated lead time, general freight terms, and delivery information are described in Section 8 (Fabrication Time, Shipping, and Risk of Loss) of these Terms, during checkout, and in your order confirmation.
4. Payment
All orders are paid for at checkout through Stripe, our payment processor. By placing an order, you authorize the charge for the full order amount, including any applicable shipping and freight costs, at the time of order.
5. Your Responsibilities Before We Fabricate Your Order
Because every product is custom-cut and custom-fabricated to your specifications, your responsibilities before fabrication begins are especially important:
a. Measurements are your responsibility.
You are solely responsible for providing accurate dimensions and specifications when configuring your order. The dimensions you enter are the finished size of the glass to be fabricated — not the size of the opening, frame, sash, or other structure into which the glass will be installed — and we make no deduction, allowance, or adjustment of any kind to the numbers you enter. You are responsible for measuring your opening or frame and for making any allowance or clearance necessary before entering the finished glass dimensions. We fabricate glass to the exact measurements you enter. We are not able to verify your on-site measurements, and errors in the measurements or specifications you provide are not considered a defect in our product.
b. Confirming your dimensions.
Before we begin fabrication, you confirm the dimensions and specifications shown in your order. This confirmation is your acknowledgment that the measurements are correct and that you want us to proceed with fabrication based on them.
c. Application and safety glazing.
Every piece of glass we sell is tempered glass. We do not make or sell laminated glass, wired glass, retention screens, or any other assembly.
Our order process requires you to state the intended use of each piece. You must choose one of these six options, and there is no default: “Window / window lite”, “Door”, “Sidelite”, “Tub or shower enclosure”, “Table top / protective cover”, or “Something else”. If you choose Door, Sidelite, or Tub or shower enclosure, we add our permanent etched tempering logo to the piece, and it cannot be removed. You may also choose to add the etch to any other piece.
The question records the use you tell us. It is not a determination that the glass meets any building code for that location. We make no such determination. We do no code-compliance review, no safety-glazing review, and no engineering review, on any order.
You are responsible for stating the intended use accurately. You are also responsible for confirming that the glass type and specification you order comply with the codes that apply at your installation site. Those codes may be stricter than your state’s minimum. If you are unsure, ask a licensed architect, engineer, or your local building official before you order.
Warning: tempered glass alone does not satisfy code for every use. It does not satisfy code for guards, handrails, sloped or overhead glazing, or skylights. We do not fabricate glass for those uses through the online order form. If your project has one of those uses, you must call us at 844-504-5277 before you order.
By placing an order, you confirm that you stated the intended use accurately, that tempered glass is appropriate for that use, and that you have confirmed the glass complies with the codes and other laws that apply at your installation site.
d. Maximum size.
The maximum finished dimension we fabricate is 48 inches on any side. We cannot produce, and will not accept, an order for a product exceeding 48 inches on any side.
6. Limited Warranty
Term and Who Is Covered
Mid America Glass & Glazing Supply (“the Company”) warrants each product for five (5) years from the date of delivery. This warranty is extended only to the original purchaser of the product and is not transferable to any subsequent owner, buyer, or occupant of the property where the product is installed.
What Is Covered
This warranty covers defects in materials or workmanship caused by the Company’s fabrication of the product. This includes seal failure in an insulated glass unit (IGU) that causes fogging or condensation between the panes. This warranty also covers a product that does not match the specifications the customer confirmed at checkout.
What Is Not Covered
This warranty does not cover:
- Errors in the measurements or specifications the customer provided
- Damage that occurs during installation
- Damage that occurs after delivery
- Breakage of the glass after delivery
- Damage in transit that is not reported as required by Section 7
- Ordinary wear, misuse, or any condition not caused by the Company’s fabrication
Remedy
If a product is covered under this warranty, the Company will, at its own option, repair the product, replace the product, or refund the amount paid for that product. This is the customer’s only remedy under this warranty.
What the Company Pays For — and What You Pay For
If a claim is approved, the Company will pay to fabricate the repaired or replacement unit and to ship it by freight to the original delivery address in the United States. The Company will not pay for, and this warranty does not cover, removing the existing glass, installing or reinstalling the unit, labor of any kind, site or access costs, scaffolding or other equipment, or any other cost of putting the replacement in place — the customer is responsible for all of these costs.
How to Get Warranty Service
To make a warranty claim, follow these steps:
- Contact the Company by email at sales@midamericaglasssupply.com or by phone at 844-504-5277 (844-50-GLASS).
- Provide your order number.
- Provide photographs of the defect or of the product as delivered.
- The Company will review your claim and tell you how it will be resolved.
You may also write to the Company at:
Mid America Glass & Glazing Supply
370115 Old Highway 64, Cleveland, OK 74020
Limitation of Remedy
The remedy described above is the customer’s exclusive remedy under this warranty. As set out in the Limitation of Liability section, the Company excludes incidental and consequential damages. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
Custom Orders Are Final
Every product is custom-fabricated to the dimensions the customer provides. Once fabrication has begun, the order cannot be cancelled, returned, or refunded, except where the product is defective as described above or does not match the specifications confirmed at checkout.
Your State Law Rights
This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
7. Shipping and Damage in Transit
Orders are crated for freight and delivered by common freight (LTL) carrier to addresses within the United States. General shipping timeframes and freight details are described in Section 8 (Fabrication Time, Shipping, and Risk of Loss) of these Terms and in your order confirmation.
Inspect Before You Sign. You must open the crate and inspect the glass while the freight driver is still present. You must note any damage, in writing, on the delivery receipt or bill of lading before you sign it. You must photograph the damage and the packaging. If the glass is visibly broken or unusable, you must refuse delivery of that item; otherwise, you may accept delivery but must note the damage in writing on the delivery receipt or bill of lading as described above. In either case, you must contact us the same day, at sales@midamericaglasssupply.com (844-504-5277 may be used as an alternative), so we can begin a freight claim. A delivery receipt that you sign without any damage noted on it is treated as your confirmation that the shipment arrived complete and undamaged.
Concealed Damage. Damage that is not apparent until after the driver has left must be reported to us the same day you discover it, at sales@midamericaglasssupply.com (844-504-5277 may be used as an alternative), together with photographs of the damage and the packaging. Freight carriers impose short deadlines for reporting concealed damage — as tight as five calendar days from delivery — and treat timely notice as a condition of recovering on a claim. A report made after a carrier’s deadline will likely make recovery on the freight claim impossible.
Why This Matters. A notation on the delivery receipt or bill of lading is a necessary first step, but it is not itself a completed freight claim. We use your notation, photographs, and report to file and pursue the freight claim. If damage is not noted in writing at the time of delivery, the carrier may deny the claim entirely. Your failure to inspect the shipment and note visible damage in writing at delivery, or to report concealed damage the same day you discover it, may forfeit our ability to recover from the carrier and, as a result, may forfeit your remedy for that shipment.
8. Fabrication Time, Shipping, and Risk of Loss
Lead Time. Your glass ships within 14 days of your order, with additional LTL freight transit time on top depending on your delivery location. This lead time is an estimate, not a guarantee, established with a reasonable basis at the time your order is placed.
If We Cannot Meet the Estimate. If we are unable to ship your order within the estimated lead time, we will notify you before the delay occurs and give you the choice to either consent to the delay and receive a new estimated ship date, or cancel your order for a full refund of all amounts paid.
Risk of Loss. Risk of loss passes to you when your glass is tendered to the freight carrier. Loss of or damage to your shipment in transit is a matter between you and the carrier and is not a defect in our product. We will still assist you under Section 7 (Shipping and Damage in Transit) in filing and pursuing a freight claim, but that assistance does not make us responsible for the carrier’s loss and does not expand any remedy beyond what Section 7 and the Limited Warranty section provide.
9. Intellectual Property
All content on our website — including text, graphics, logos, product configurator tools, and images — is owned by Mid America Glass & Glazing Supply or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our content for commercial purposes without our written permission.
10. Disclaimers
Our website and the information on it are provided “as is.” While we make every effort to ensure our online pricing and configuration tool are accurate, final pricing and product specifications are subject to the dimensions and options you confirm at checkout. We do not guarantee that the website will be uninterrupted or error-free.
11. Limitation of Liability
Your exclusive remedy and our entire liability for any product we deliver that is defective or does not match your confirmed specifications is, at our option, repair of the item, replacement of the item, or refund of the amount you paid for that item.
Consumer Transactions. If you are a consumer, nothing in this section limits or excludes our liability for personal injury to you to the extent such a limitation would be unconscionable or otherwise unenforceable under applicable law, including Okla. Stat. tit. 12A, § 2-719(3). Subject to that carve-out, all other damages — including indirect, incidental, and consequential damages, and damages related to installation, delay, loss of use, and property damage other than to the delivered item itself — are excluded to the fullest extent permitted by law.
Commercial Transactions. If you are purchasing in a commercial capacity, the exclusion of consequential, incidental, and indirect damages applies in full, including injury to property, business interruption, and lost profits, to the fullest extent permitted by law.
Savings Clause. If any limitation in this section is held unenforceable as to a particular claim, it is reduced only to the minimum extent necessary to make it enforceable as to that claim, and every other limitation in this section remains in full force and effect. If the remedy of repair, replacement, or refund fails of its essential purpose as to a given claim under Okla. Stat. tit. 12A, § 2-719(2), the exclusions of consequential and incidental damages set out above still apply to that claim to the fullest extent permitted by law.
12. Governing Law
These Terms are governed by the laws of the State of Oklahoma, USA, without regard to its conflict-of-law principles.
13. Changes to These Terms
We may update these Terms of Service from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of our site or placing an order after changes are posted means you accept the updated Terms.
